Delhi government has recommended that a number of provisions that require various verifications and approvals be deleted It has also recommended that the protection granted to unauthorised colonies be extended to colonies that have come up as recently as January 1 2015 The existing regulations notified in 2008 and renewed in 2014 apply to constructions that had been in existence before June 1 2014 In its recommendations for amendments to the Ministry of Urban development on November 12 the government has extended the deadline The details of the proposal were submitted before the Delhi High Court in an affidavit filed on Tuesday The proposal will now be considered by the Centre and the court The proposed regulations have done away with the requirements of filing various verified layout plans maps approvals etc Instead it states that satellite images from GeoSpatial Delhi Ltd would be used to determine layout and boundaries of colonies Share This Article Related Article It also proposed to give more power to the “field functionaries” of the revenue department recommending that the layout plans submitted by the resident welfare association (RWA) as well as the satellite imagery be sent to the revenue department which would employ the “field functionaries” to verify the boundaries The proposal also includes “relaxation” of the Delhi master plan to accommodate the unauthorised colonies constructed by January 1 2015 The government has recommended that the change of land use norms be relaxed and the layout plan be approved on an “as is where it is basis wherever it is considered to be justified” The proposals are set to bring relief to the ‘affluent’ unauthorised colonies such as the Sainik farms area with the government recommending that the provisions that left the “affluent colonies” out of the purview of regularisation be deleted “There is no merit in categorising some colonies as affluent and others as non-affluent” states the document submitted by the Delhi government adding that it could “consider determining affluent residents based on plot size and have higher charges for the public land penalties for development charges etc for such residents” The government has suggested that unauthorised colonies on category-A land be charged Rs 18000 per square meters as “cost of land” for occupying public land for plots upto 100 sq metres going up to Rs 27000 per sq mt for plots bigger than 200 sq mt In addition such colonies would have to pay between Rs 9000 and Rs 13500 per sq mt as regularisation charges depending on plot size Colonies in the “poorest category” of “F to H” will have to pay between Rs 500 and Rs 4000 per sq mt but would not have to pay any regularisation charges Incidentally the government has also recommended that the “development charges” levied on the occupants of unauthorised colonies for improvement of the municipal facilities roads etc should also be done away with and only the cost of land and the regularisation charges be levied This would imply that people in the “poorest” colonies would not have to pay any charges apart from the “cost of land” for occupying public land and would not pay any costs if they have come up on “private land” The affidavit was submitted in response to the Delhi High Court direction to “create a policy” regarding possible regularisation of
